Asad Khan Asks for Release from Supervision

On October 25, Asad Khan came before the Court, asking to be released from probation, citing that he has served eight years of a 12-year suspended sentence. He said it is very hard to support his family (both in Stockton, California and Pakistan) on the jobs he can get, while on probation.
On Monday, March 9, 2015, a semi-truck, driven by Asad Khan, Stockton, CA, was driving east on Highway 12, when it ventured into the oncoming lane of traffic near mile marker 57. The resulting head-on collision killed the driver of a pick-up, Gregory McFerrin, East Helena.
Friday, March 13, Khan appeared before Judge James P. Reynolds. Khan, 33, who is a Pakistani national, speaks and understands very little English, so an interpreter had to be found to ensure that his rights would not be violated and that he understood the charge and the penalty for that charge. Dr. Ruth Vanita, MSU, traveled from Missoula Friday morning to interpret Urdu, the language that Khan speaks.
According to court documents, Khan is charged with Negligent Homicide, which carries a penalty of up to 20 years in prison, a fine of $50,000, or both.
He received a Sentence of 12 years suspended at that time, from Judge James Reynolds (retired). He was able to go back to Stockton, where his immediate family lives, in order to begin a better life.
He has paid all fines and restitution to the McFerrin family: coming to court to have the rest of his sentence forgiven.
Judge Christopher Abbott (who replaced James Reynolds after retirement) agreed that the last four years of his sentence should be deferred…if Khan has a Petition to Revoke; he must serve four years at Montana State Prison.
