The criminal docket in Judge Christopher Abbott’s courtroom on Friday, October 25 is as follows:

Jessica Guillermo had an Initial Appearance and Arraignment; pleading Not Guilty to criminal endangerment and aggravated DUI (3rd) and open container. Omnibus is due December 6; Pre-Trial is set for March 28, 2025; with the Jury Trial scheduled for April 21.

Michael Taylor was found guilty of DUI in Justice Court; and is appealing that conviction in District Court. Omnibus is due by December 6; Pre-Trial is set for March 28; with the Jury Trial scheduled for April 21.

Edward Mierow had a Sentencing on a charge of criminal possession of dangerous drugs (meth). He is Sentenced to 4 years deferred; to run concurrently to his charges in Lewis & Clark County charges. He must have a chemical dependency evaluation and enroll in Treatment Court; pay $80 fees and surcharges, as well as pay a $300 Public Defender fee.

Kyle Mostad had a Petition to Revoke on a firearm charge. The Federal trial is delayed. He is Sentenced to seven years D.O.C.; with 748 days credit “street time”; with 5 years suspended. He must serve 90 days in jail, in 14-day increments.

Asad Khan appeared for a Motion to end Supervision; after serving eight years on a 12-year suspended sentence. He has paid restitution to the McFerrin family and paid all fines. The judge granted him a conditional release; but if he receives a revocation in the next four years, he will have to spend four years at Montana State Prison.

Jeremiah Howe appeared for Sentencing on a Plea Agreement; after a trial jury came back as ‘hung’ demanding a mistrial on charges of sexual assault (s) on minor(s). Judge Abbott said that he believes what the children told the Court during the Jury Trial. Per the Plea Agreement, he has pled guilty to assault on a minor and two counts of partner/family member assault. He is Sentenced to six years deferred, with no early release. A new psycho-sexual evaluation is ordered. He is not to contact the three victims, nor get within 1500 feet of them. The Pre-Sentence Investigation fee is waived, but he must pay fees and surcharges of $80. He must attend Behavior Modification Therapy, Moral Recognition Therapy and Batterers Education (with those completed within two years). He must follow all other conditions.
