Montana’s 2nd Legislative Branch
The crafting of law was already done by the 2023 Legislature, yet the Montana Supreme Court believes they now get their own session of lawmaking. For years now, the court has overstepped its role and it has led to endless litigation after every session.
The Court needs to remember its role; interpret the law and rule on its Constitutionality. The strength of the judiciary is founded on impartiality and adherence to staying in its lane; not becoming the second legislature.
We need to elect leadership to the court that will put an end to judicial activism. In Cory Swanson’s words, the job of the Chief Justice is “to make the court boring, not light it up with attention”.
If even Justice Sandefur calls the Supreme Court ‘out of control’ then let's elect someone like Swanson to reign it in.
