The criminal docket in Judge Michael McMahon’s courtroom on Friday, September 9 was as follows:

Angela Kidder appeared by Zoom with her attorney, Victor Bunitsky, for her Pre-Trial Conference. Her charges are the illegal transfer of drugs to a person subject to official detention, illegal transfer of a prohibited article (cell phone) to a person subject to official detention, and driving while her license is suspended or revoked.

According to court documents, Deputy Tony Cordova, after seeing Kidder at Town Pump, running her plate and finding out she was driving without a license, came upon Kidder in the parking lot adjacent to/across from the Broadwater Billings Emergency Room.

Kidder was seen in black pants and a black hoodie as Deputy Cordova was called to escort prisoner Donald McCubbins to the Emergency Room, the evening of April 20, 2021. On the night of April 23, 2021, Prisoner McCubbins again requested to go to the E.R.

TaraLynn Matthews was asked to accompany Mc­Cubbins to the E.R. for an unspecified illness. On McCubbins’ way back, as he was shackled with his wrists held in front, he fell into a pothole or puddle. Allegedly, he picked up a parcel filled with 3.5 grams of methamphetamine, which he put into his mouth and attempted to hide. During this time, the sheriff’s deputies retrieved the contraband. McCubbins chewed on the parcel he was hiding, which proved to be methamphet­amine. Later, a cell phone, which is prohibited, was found with Kidder’s info in it. Not surprisingly, in her name, with a number that she had given as “contact.”

John Simpson appeared for extradition for a charge out of South Dakota for “sexual imposition”. Trans­portation is available until October 10 when, if not answered, he will be released.

Jimmy Joe Flanigan will be seen for a Change of Plea on September 15, 2022.

James Swan III will have a Change of Plea on October 14, 2022.

Casey Smith was arrested and charged with a Fail­ure to Appear on a Change of Plea and Sentencing on charges of assault with a deadly weapon, burglary, and criminal mischief and partner/ family member assault. Whereon January 9, 2022, when allegedly, Smith broke the locking devices on the rear door of the residence occupied by his parents and threatened his father with a broken part of the door jamb. Which had broken when Smith was gaining entrance to the home. According to court documents, Sgt. Jamie Buck responded to the scene. Terry Smith, the plaintiff, told the officer that they had told the defendant, Casey Smith, that he was not welcome at their house. The owners of the home at 200 S. Oak Street, Terry and Melissa Smith, reiter­ated to Deputy Jamie Buck that Casey Smith was not allowed at their home.

This file is dated January 20, 2022. After a prolonged private hearing, it was decided that Smith pleads Guilty to the Amended count one, criminal endangerment. All other charges are dismissed. He receives a four-year deferred sentence with a follow-up on a chemical dependency evaluation, as well as a mental health evaluation. He is to pay $80 in fees and surcharges and a $110 restitution. He is also to comply with all conditions of Adult Probation & Parole and must submit his DNA. He is ordered to not contact the victims or be within 300 feet of their home.
