The criminal docket in Judge Michael McMahon’s courtroom on Friday, October 14 was as follows:
Steven Barnes III had an Initial Appearance and Arraignment on a charge of sexual assault; when the victim is less than 16, and the perpetrator is 3 years or older than the victim. Omnibus is due by November 25. The pre-Trial is set for March 24, 2023, with the Jury Trial scheduled for April 24. His bond was reduced from $50,000 to $25,000 with the understanding that if he is released, he will wear a GPS monitor. He is to stay away from Willow Creek, MT and not have contact with the victim or witnesses. He has permission to live with his mother in Three Forks.
Brittney Betts appeared in court for her fourth Petition to Revoke a suspended sentence. She pled a Denial to the allegations of harassing and/or bullying others on social media, after being specifically ordered not to use social media at all. An Evidentiary Hearing is set for December 9. She has a bond of $25,000. She must have an updated mental health evaluation. She is not to have a phone or computer, or anything that allows her access to the internet.
James Swan had his Change of Plea continued until December 9.
Wayne Johnson had his Initial Appearance continued until October 21.
